Acceptance of Terms

By accessing or using our services, including but not limited to EV charging installations, turnkey solutions, property assessments, and ongoing station management, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use our services.

Scope of Services

Enertech provides the following services to property owners and managers across Colorado:

Free Site Assessment – Evaluation of property eligibility for EV charging stations.
Turnkey Installation – Full installation of EV charging infrastructure at no upfront cost, unless otherwise agreed.
Ongoing Management – Maintenance, monitoring, and customer support for installed EV charging stations.

All services are subject to availability and a signed service agreement.

Eligibility

To access our services, you must:

Be at least 18 years of age.
Be the legal property owner, manager, or authorized representative of the property where services will be provided.
Provide accurate and complete information during the assessment and installation process.

Costs and Payments

Many of our services are offered at no upfront cost. Any exceptions, fees, or payment responsibilities will be clearly outlined in a separate agreement before installation.
Enertech reserves the right to introduce service or management fees in the future with proper notice.

Property Owner Responsibilities

By using our services, you agree to:
- Grant Enertech access to your property for site assessments, installation, and ongoing service.
- Maintain compliance with local regulations, HOA/COA rules, and zoning requirements.
- Notify Enertech of any changes to property ownership, utility accounts, or other factors that may impact service.

Equipment Ownership

Unless otherwise agreed, EV charging equipment installed by Enertech remains the property of Enertech.
Property owners may not sell, tamper with, or transfer ownership of installed equipment without written consent.

Service Limitations

Enertech strives to provide reliable services, but we cannot guarantee uninterrupted access due to factors beyond our control, including utility outages, internet disruptions, or third-party actions.
We are not liable for any indirect or consequential damages caused by service interruptions.

Liability

Enertech is not responsible for:

Unauthorized use of EV charging stations.
Damages resulting from misuse, vandalism, or accidents beyond our control.
Loss of revenue, property value, or business opportunities related to installation or operation.

Our liability for any direct damages is limited to the extent permitted by law.

Termination

Enertech reserves the right to suspend or terminate services if:

The property owner breaches these Terms.
The property becomes unsuitable for continued operation.
Continued operation is no longer commercially or legally viable.

Privacy

All personal and property information collected will be handled in accordance with our Privacy Policy, available on our website.

Governing Law

These Terms and Conditions are governed by the laws of the State of Colorado, without regard to conflict of law principles.

Changes to Terms

Enertech may update these Terms and Conditions at any time. Updates will be posted on our website with a revised effective date. Continued use of our services constitutes acceptance of updated terms.
